Their homestead established in 1871, Block No. 127, was divided equally between the two; ajudged that the respective portions allotted to each be held by them respectively, free and clear of all claims by or on the part of the other. Prior to the divorce, Mr. Chalfant ... recovered a judgement against John Shoemake, and after the decree of divorce was rendered, caused the premises in to be levied upon under an execution issued in his judgement" It would seem John Shoemake claimed his portion of the homestead was protected under the Homestead Act, and thus judgements could not be levied against it.
